Child Custody Case Study


A client going through a divorce contacted us to help him gain custody of his children. When the client and Subject first separated, the children were allowed to live with the Subject in their current home. Since then the Client has learned that his ex is now stripping at a gentlemen's club and keeping company with unsavory men in their home. He doesn’t think this is in the best interest of his children and is now seeking full custody of them. The Client wants evidence that his ex-wife should not have custody of their children due to the recent change in her lifestyle.


Summary:

A client going through a divorce contacted us to help him gain custody of his children. When the client and Subject first separated, the children were allowed to live with the Subject in their current home. Since then the Client has learned that his ex is now stripping at a gentlemen's club and keeping company with unsavory men in their home. He doesn’t think this is in the best interest of his children and is now seeking full custody of them. The Client wants evidence that his ex-wife should not have custody of their children due to the recent change in her lifestyle.

ICS devised a plan to conduct surveillance on the Subject, as well as a background investigation into the new men she is keeping company with.

Conclusion:

The investigator went to the men’s club on the night the Client told him his ex would most likely be working. He positioned himself far enough from the stage so that the Subject wouldn't be able to see him. He sat in the club until 2am and never observed the subject.

The next day, the investigator conducted surveillance on the Subject’s home. He observed a truck parked in the driveway that didn’t belong to the Subject. After running the plates, he discovered the identity of the owner and began a background check. The background investigation turned up a criminal record where the second subject was accused of assault and battery. He had spent 4 years prior in jail and was currently serving a 15-year probation.

Around 7am, the male subject was observed leaving the house swearing loudly. He got in the truck, and spun out down the road in a hurry. Several photos were taken at that time.  An hour or so later, the primary Subject was observed leaving with two children in her car.  The investigator began mobile surveillance and followed them to a school where he observed the children exiting the car and walking into the school.  He continued following the Subject and observed her driving down a lone alley where she parked and entered an old apartment building. The investigator maintained visual contact and observed her exit the building with a small packet in her hand. Although the packet the woman had couldn’t positively be identified, zoomed photos he had taken looked like it contained a white powder and could possibly have been cocaine or other drugs.

He continued his mobile surveillance and followed the subject home where he observed her enter her residence. The only movement he observed in the next several hours were the children and the secondary male Subject pulling into the driveway and exiting the truck.

Later that night he observed the 2 children in the home watching TV with the male subject. The primary Subject was seen exiting the house and the investigator again decided to follow her. This time the investigator followed her to the men’s club where he had previously looked for her. He waited about 30 minutes then entered the club and sat in the same seat he had the previous evening. Three dancers came out on stage and the Subject was not observed anywhere. About an hour later, the Subject came out on stage and danced. Discreet photos were taken and a hidden video was able to show the subject dancing on stage and interacting with men in the audience.

The surveillance reports and background investigation were provided to the Client along with the photos and video. Although the client was upset that his ex had made such a drastic change in her lifestyle, he was optimistic the evidence would gain him full custody of his children.
